Hotel Accommodation Agreement – Garden Hotel Krefeld
Dear Guest,
Please take a moment to read our General Terms & Conditions. They govern the legal relationship between you and Garden Hotel Krefeld.
1. Scope of Application
1.1 These terms apply to contracts for the rental of hotel rooms for lodging as well as all other related services and deliveries provided by the hotel (Hotel Accommodation Agreement).
1.2 Subletting or re-letting of rooms as well as their use for other purposes requires the prior written consent of the hotel. Section 540 (1) sentence 2 BGB does not apply unless the customer is a consumer.
1.3 General terms and conditions of the customer apply only if expressly agreed in advance.
2. Contract Conclusion, Partners, Statute of Limitations
2.1 The contract is concluded when the hotel accepts the customer’s request. The hotel may confirm the booking in text form.
2.2 All claims against the hotel generally expire after one year from the start of the statutory limitation period, except for damage claims resulting from intent or gross negligence.
3. Services, Prices, Payment, Set-off
3.1 The hotel is obliged to provide the booked rooms and services agreed upon.
3.2 The customer must pay the agreed or applicable hotel prices for rooms and additional services. This also applies to third-party services arranged by the hotel.
3.3 Prices include applicable taxes and local charges at the time of contract conclusion, excluding local taxes payable directly by the guest (e.g., city tax). Changes in VAT or local charges may adjust the prices accordingly.
3.5 Hotel invoices without due date are payable within 10 days. In case of late payment, statutory rules apply.
3.6 The hotel may require an advance payment or security deposit upon contract conclusion. Additional deposits may be requested in justified cases.
4. Guest Cancellation (No-Show)
4.1 Cancellation by the guest is only possible if a right of withdrawal was agreed upon, statutory rights apply, or if the hotel consents.
4.3 If cancellation is not possible, the hotel retains the right to the agreed payment minus any income from alternative rental and saved expenses. The hotel may charge:
- 90% of the agreed price for overnight stays with or without breakfast
- 70% for half-board arrangements
- 60% for full-board arrangements
5. Hotel Cancellation
The hotel may withdraw from the contract in cases such as non-payment of required deposits, false booking details, unlawful purpose, or force majeure. A justified cancellation by the hotel does not create compensation claims for the guest.
6. Room Availability, Handover & Return
6.1 Guests have no entitlement to specific rooms unless expressly agreed.
6.2 Rooms are available from 3:00 p.m. on the day of arrival.
6.3 Rooms must be vacated by 12:00 p.m. on the day of departure. Late departures may incur charges of up to 90% of the daily room rate.
7. Liability of the Hotel
7.1 The hotel is liable for damages to life, body, or health, as well as for other damages resulting from intent or gross negligence.
7.2 The hotel recommends using the in-room or hotel safe for valuables. Liability for items exceeding €800 (cash, securities) or €3,500 (other valuables) requires a special agreement.
7.3 Parking does not create a safekeeping contract. The hotel is only liable for damages as per section 7.1.
8. Final Provisions
8.1 Amendments or supplements must be in text form.
8.2 Place of performance and jurisdiction is Krefeld, Germany.
8.3 German law applies.
8.4 We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
8.5 If individual provisions are invalid, the remaining terms remain binding.
